More Trial Transcript Snippets: Examination by the Court

Harlow Cuadra

PPO: I want to direct your attention to when you were in the home with Mr. Kocis.

Harlow Cuadra: Yes, sir. Yes, your Honor.

PPO: You heard a knock on the door and Mr. Kocis went to answer the door.

Harlow Cuadra: Yes, your Honor.

PPO: He opened the door a little bit and then Mr. Kerekes burst in?

Harlow Cuadra: Yes. Yes, your Honor.

PPO: Did Mr. Kerekes have anything with him when he came into the home?

Harlow Cuadra: No. When I saw him reach in for the knife and it was not that -- it was not the big one. It was that small one that --

PPO: My question was, was he carrying anything with him?

Harlow Cuadra: Not in his hands, sir. Not in his hands, your Honor.

PPO: After Mr. Kocis was killed and you went out to the Xterra--

Harlow Cuadra: Yes, your Honor.

PPO: -- did Mr. Kerekes come out to the Xterra and then return to the house to start the fire?

Harlow Cuadra: Now I know that he returned to the home to start the fire; but when he returned to the home, it was to get another arm full of electronics. It was a total of three lap -- computer towers that I phsically myself saw.

PPO: My question is, when he came out to the Xterra, did he take anything back into the home with him?

Harlow Cuadra: I did not notice that, your Honor. I did not.

PC, could you tell us what the context of this Q&A is? I don't think I've ever heard of a judge eliciting such testimony from a defendant. Was it out of the presence of the jury? It seems very strange.

According to the transcripts, it was labeled as "Examination by the Court".

It was done at the end of Harlow's testimony, in the presence of the jury.

At the end of his questioning, PPO then asks: "if either Counsel would like to follow up those questions, they may, beginning with Mr. Walker."

Both sides declined.

I should also note that this was only about half of what PPO asked. For obvious reasons, I'm not going to post the entire thing. :)
