The appeal was filed to the Superior Court of Pennsylvania by Attorney Paul J. Walker, and is for "the Conviction and Sentence on March 16, 2009".
Update @ 4:39 PM: Sources tell me that the folks who handle the appeals to Superior Court said they have never seen a notice filed quite like the one that was filed yesterday. There is usually more substance than that [it was 1 page - the picture above]. Apparently the judge will be filing an order directing counsel to file a concise statement of matters of appeal within 20 days, probably by tomorrow, and that is when all of the issues will be raised.
This blog is basically an archive of the trial news, facts, and opinions related to convicted murderers Harlow Cuadra and Joseph Kerekes for their brutal slaying of Bryan Kocis in his rural Pennsylvania home. Harlow and Joe are currently serving life in prison without the possibility of parole. I will continue to update this blog for the duration of Harlow Cuadra's plea for a new trial.

No suprise really, though I figured they would use up as much time as they could before they absolutely had to file it... they still had a few more days.

ReplyDeleteStandard procedure in 1st Degree cases anyway. It will give all the lawyers many years of billing the State.

It was only one page... with no explanation as to why an appeal was being made.

ReplyDeleteI don't know what PA tradition is regarding these notices, but it's a model of brevity. ;-)
I've never seen one filed with so few words. Lawyers are famous for being able to fill pages with inconsequential information -- like social scientists.

Tell me about it, all one has to do is look at the number of filings before the trial... pages and pages of 'speak'.
I'm not even sure if the Superior Court has accepted the appeal, as they haven't issued a docket number for it, and they're usually pretty quick about doing that.
I am mildly surprised that the appeal request is so short also but as an SCCA (Sports Car Club of America) steward, a decision by the stewards of the meet may be appealed and it requires no more than notice of appeal to the Court of Appeals. The specifics follow within 10 days. PA courts may allow the same sort of proceedure.

From what I heard on the 10th (see update to latest post), I'd say you're 100% correct.
this appeal is not unusual at all. the only thing mising is the page that would request transcripts. if you read the first page it says they are appealing his sentence. it's to the point. the rest will come out in the concise statement and briefs.
