Update @ 07/20/2010: I probably should have clarified this earlier... but... this isn't Harlow Cuadra's actual appeal that's being decided, but rather the court has received all they need, and they've appointed the three judges listed below to review the appeal and consider the merits.

Harlow Cuadra is currently serving a double-life sentence for the brutal murder of Bryan Kocis. His co-defendant Joseph Kerekes, pleaded guilty in December 2008 to second-degree murder and was sentenced to life in prison.
if something serious comes out of this appeal does that delay the book launch?

Nope.
The judges have to review the entire record and transcripts. We probably won't see anything for a very long time.
Sometimes, like with the Hugo Selenski case, it's taken an entire year to find out something. Though, you never know. This is the judicial system, and they work on their own timing. :)
I should also add... assuming Caudra's appeal is turned-down by the Superior Court (which I think it will be), he can always appeal to the Supreme Court of PA... which will likely take another year or two... or more.

ReplyDeleteI didn't realize Harlow got a DOUBLE life sentence...why, when Joe only got a single life sentence? just because he didn't plea bargain? that in itself sounds like grounds for appeal and perhaps an order for resentencing, at least to me...

Not at all...
Joe plead guilty to Criminal Homicide, and was sentenced to life in prison.
Harlow was found guilty of Criminal Homicide and Criminal Conspiracy Engaging... both charges carry a life sentence. Had Harlow agreed to a plea-bargain, he probably would have gotten the same as Joe... but he didn't.
I really don't see anything that would be considered 'unfair'.
