The Superior Court of Pennsylvania has upheld the conviction and life sentence handed to Harlow Cuadra for the murder of Bryan Kocis. No additional appeals have been filed as of today.
In a five page ruling issued on Oct. 14, the Superior Court upheld Cuadra’s conviction and sentencing, stating Olszewski’s rulings before and during Cuadra’s trial were “well detailed and well-reasoned.”
“We can find no error in its factual findings and corollary legal conclusions,” the appellate court ruled on each of the issues Cuadra challenged.

ReplyDeleteIt's all over. The Pennsylvania Supreme Court will almost certainly not accept an appeal, and any collateral attack through the Federal courts has zero basis in the law.

I think there is a snowball's chance in Hell that the Pennsylvania Supreme Court would review this case:
ReplyDeleteThe Supreme Court receives about 2,500 civil and criminal appeals each year. It has the discretionary power to hear and decide only those cases that it deems to have statewide importance or to require clarification on a point of law.
As long as the money holds out, an appeal will be filed regardless of merit. Lawyers can usually find SOMETHING to dispute
